Terms of Service

By accessing or using WinYourQuote (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and WinYourQuote (“WinYourQuote”, “we”, “us”, or “our”).

WinYourQuote is a software-as-a-service platform that helps trade and service businesses automatically follow up on unsold quotes via SMS. The Service includes automated messaging, quote tracking, analytics, and related features as described on our website. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. You must be at least 18 years old and have the authority to enter into these Terms on behalf of your business.

WinYourQuote offers paid subscription plans billed on a monthly or annual basis. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are non-refundable except as required by applicable law. We may change our pricing with 30 days' notice. If you cancel, your access continues until the end of the current billing period. Free trials automatically convert to paid subscriptions unless cancelled before the trial ends.

WinYourQuote sends SMS messages to your customers on your behalf. By using the Service, you represent and warrant that:

• You have obtained all necessary consents from your customers to receive SMS communications
• Your use of the Service complies with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all other applicable laws and regulations
• You will honour opt-out requests from recipients promptly
• The phone numbers you provide belong to your customers who have a business relationship with you

WinYourQuote provides tools to facilitate compliance but you remain solely responsible for ensuring your messaging practices comply with applicable law. WinYourQuote is not liable for fines, penalties, or legal claims arising from your messaging activities.

You agree not to use the Service to:

• Send unsolicited or spam messages
• Harass, threaten, or harm any person
• Violate any applicable law or regulation
• Transmit malicious code or interfere with the Service's operation
• Attempt to gain unauthorized access to any part of the Service
• Resell or sublicense the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these provisions without notice.

Either party may terminate these Terms at any time. You may cancel your account through your account settings or by contacting support. We may suspend or terminate your access immediately if you breach these Terms, fail to pay fees, or if required by law. Upon termination, your right to use the Service ceases and we may delete your data in accordance with our data retention policy.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WINYOURQUOTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
